Pro-animal groups voiced rage at the cull, and said poultry farms should be made illegal.

Water birds are especially susceptible to the H5N1 virus, which can be fatal to humans. The fight against its spread is driven by the fear that the virus could mutate and possibly cause massive loss of human life worldwide.

apparantly there was confusion, because H5N1 was only found in frozen
ducks, which doesn't formally count as outbreak.
I speculate that they routinely store a sample from each production-series
for later proof in eventual trials and these were infected.
But they were hesitant to say this earlier, because of consumer-reaction.

...a classification used in epidemiology to describe a small, localized group of people or organisms infected with a disease. Such groups are often confined to a village or a small area.

I think, it's a European regulation, not national.

Those samples can be some weeks old, are maybe stored elsewhere.
By the time the virus is found, it could already have died in the farm.

But in this case with influenza, well, they did cull and quarantine,
just formal juristical subtleties.

This is just German mumbo jumbo trying to ignore low path H5N1 (much like the mumbo jumbo worldwide, including Canada trying to explain away the dead geese at Prince Edward Island).

However, it now is moot since high path H5N1 was found and a quarantine has been imposed. It's an outbreak and it's Qinghai H5N1 in asymptomatic ducks.

The regulations on H5 extend well beyond Germany. All countries belonging to the UN have signed off on WHO regulations, which make both H7 and H5 reportable diseases, regardless of high or low path status. Thus, H5 is reportable to OIE.

Since most of the coverage of the outbreak in eastern Bavaria is in German, I may be missing some of the nuances, but the argument hinges on killing of birds that are not sick.

Asymptomatic ducks can be asymptomatic due to low and high path infections. Low path H5N1 in Europe is quite different than high path. Low path doesn't have the polybasic cleavage site and generally does not kill chickens or ducks. High path, (including Qinghai) however is more likely to kill chickens than ducks. Since all recent H5N1 infections west of China have been Qinghai, the high path in Germany, including asymptomatic ducks, is almost certainly Qinghai.

The most recent data indicates high path has been found on the farms, therefore the controversy on the term "outbreak" for the infected ducks is moot.

However, H5N1 that is asymptomatic in ducks (or other waterfowl) can still kill humans, and of course asymptomatic host are the most effective mechanism for transport of H5N1.

as I understand, they didn't find any low-path H5N1.

They first found the HP-H5N1 in frozen control-samples and
also antibodies in ducks, but this doesn't already require the EU-regulations
about the 0.5km , 3km , 10km , 15km zones.
Still enough reason to start the culling.
Then they also found H5N1 in healthy ducks and
the zones had to be established.

These control samples are presumably routinely collected for
salmonella etc. surveillance or quality control.
Maybe they weren't even stored at the farms but at central places.
