Health Minister Dr G.A. Siwabessy requests American assistance to help Indonesia deal with measles and malaria.

January 16, 1970
Namru-2 lab officially opens in Indonesia, marked by the signing of an MoU by Siwabessy and Francis Galbraith, the US Ambassador in Jakarta. There is no time limit, but the MoU mentions that any cancellation within the first 10 years must be agreed upon by both countries. Either party can cancel the agreement unilaterally after that time.

November 9, 1998
Defense Minister/Armed Forces Commander General Wiranto sends a letter to the Health and Foreign Ministers. The contents include an evaluation on the Namru lab, saying it is not useful, and that the cooperation between the two countries must be ended.

October 19, 1999
Foreign Minister Ali Alatas sends a letter to President B.J. Habibie, asking that the Namru agreement be reviewed.

January 28, 2000
Indonesia unilaterally stops the Namru-2 program through a letter sent by Foreign Minister Alwi Shihab. However, the government announces it is willing to negotiate a mutually beneficial agreement. On the same day, the US embassy responds that they are ready to negotiate.

August 25, 2004
Foreign Minister Hassan Wirajuda sends a letter to the Coordinating Minister for Politics & Security, Defense and Health Ministers. It is a recommendation to close the Namru lab, right after any current projects are completed.

November 2004
Health Minister Siti Fadilah Supari closes the Namru lab, but it is immediately reopened on the order of the President.

November 7, 2006
The planned visit of US President George W. Bush and the Namru lab are discussed at a coordination meeting of ministers in charge of politics and security.

November 20, 2006
Bush meets with President Yudhoyono at the Bogor Palace. The Namru lab is among the points emphasized in a joint statement made by the two heads of state.

January 9-10, 2007
The Indonesian delegation, led by Harry Purwanto, Foreign Affairs Department Director for North and Central American Affairs meets the US delegation in Jakarta. A number of clauses are debated and to date remain unresolved.

November 2007
Indonesia sends the final draft to Washington, including the clauses which America objects to.

April 1, 2008
US Secretary of Health, Michael O. Leavitt, visits Indonesia and discusses a time extension for the Namru-2 lab.

April 18, 2008
The Health Department forbids sending samples to the Namru-2 lab until a new agreement is signed.

I have read these threads carefully, but I can not seem to find the justification. Can someone explain why US citizens that are researchers and administrators at NAMRU require diplomatic immunity?

?Their reason was that they wanted protection for their citizens in times of crisis,? said Harry Purwanto, who now heads the Indonesian delegation.

Firstly I would like to thank Ningtyas for the time and effort he has put into explaining the way this is playing out in Indonesia and the careful way in which he has provided references and links where ever possible. Having a native speaker who is exposed to the full media environment on the ground and the details of the Indonesian side of the story has no substitue and is very much appreciated. As is the help with translation – I wish I could speak any other language as well as you write in English.

I am unclear why <st1:country-region><st1:place>Indonesia</st1:place></st1:country-region> expects ‘direct benefits’ from NAMRU, it is a 20 man research unit and its output is data not new drugs or even patient care. If they were promised anything else it would be interesting to know what and why.

NAMRU is a guest of the Indonesian people and will either need to stay, or go, on their terms. I hope they stay as their research is valuable at a global level – if not directly to the local population – and <st1:country-region><st1:place>Indonesia</st1:place></st1:country-region> is part of that global population. Whether <st1:country-region><st1:place>Indonesia</st1:place></st1:country-region>, and other developing nations, get as fair a share of that global pie as they should is a separate question and extends far beyond vaccines or pharmaceuticals.

According to the timeline posted above by Ningtyas, these differences have been brewing for almost 10 years.


November 2004
Health Minister Siti Fadilah Supari closes the Namru lab, but it is immediately reopened on the order of the President.

Given that Supari tried to close NAMRU in November of 2004, it could not originally be related to "virus theft" or sequencing of H5N1 in Indonesia because the first human case in Indonesia was an 8 year old girl, Sabrina Nurul Aisyah, who was infected in June of 2005 and died the following month. That was more than six months after Supari tried to shut down NAMRU.

Does anyone have access to the complete draft MoU (Memorandum of Understanding) so that it can be posted here. It would be good if we all knew what the clauses were that are so troublesome.

The second highlight is just to show NAMRU-2 is in the same DoD structure and so presumably have the same diplomats negotiating their MoUs.

And the 3rd is a possible reason for distrust of the unit being completely free of BigPharma. On the face of it viewed just as a naval unit it would seem odd if their financing was not wholly from Navy funds but it seems both the funding and diplomatic status of these units is a bit more complex than you might think.

All this is my guess work based on the assumptions above, and should be treated as such until verified.

As for NAMRU-2 being our guest, then I agree with Jakarta Post.
They come because we invited them to help us, and for that we are grateful. But when our guest play the spy games, then the welcome mat should be withdrawn.

The major stumbling block is indeed the issue of diplomatic immunity. However its not the only one thing in dispute. From the same link in Tempo interaktif, this week edition (the page is recycled regularly).

Defense Secretary Gates moves to enhance US ties with Indonesia

JAKARTA (AP): U.S. Defense Secretary Robert Gates vowed to help Indonesia reform its military, saying the U.S. was ready to help provide airlift and other maritime capabilities the country needs.

And in what appeared to be a response to previous Indonesian criticism that the United States can be overbearing in its foreign and military policies, Gates said the U.S. can play a supportive role as countries like Indonesia map out their own futures.

"From time to time, we have strayed from our ideals and we have been arrogant in dealing with others," Gates said in a speech Monday to the Indonesian Council on World Affairs.

"In the end, we have always realized that our own democracy's strength ultimately depends on the strength and independence of other democracies around the world - including new ones such as Indonesia."

He emphasized America's ongoing commitment to the region, but also said nations in the area must also work together.

"Countries have sometimes found it hard to work with us, or with each other," Gates said. "But we believe that the nations of the region must move in a more multilateral direction in order to deal with the most pressing threats in this era."

During a press conference earlier in the day with Indonesia Defense Minister Juwono Sudarsono, Gates said they discussed how the U.S. "can contribute to ongoing efforts to reform Indonesian military and develop its capabilities especially in the airlift and maritime domains. Whether by training or by providing equipment, the United States stands ready to assist in whatever way we can."

And while Indonesia has had talks with other countries - including Russia - to secure military equipment, Sudarsono said he has no problem engaging with the United States to buy additional C-130 airlift aircraft and spare parts to refurbish his country'saging F-16s.

Gates said officials are working to improve the U.S. foreign military sales system, which can be overly bureaucratic and sluggish. And he told Indonesian President Susilo Bambang Yudhoyono that the Pentagon would try to facilitate whatever upgrades or aircraft procurement they want.

Saying that Indonesia is considered by many to be "an indicator of the health of the entire region," Gates said it plays a leading role in peacekeeping and maritime security in the Asian Pacific.

Cooperation in the region, he said, would play out against a backdrop of the rise of India, the growth in China's military might and the ongoing threats from North Korea.

Those challenges are complicated by rogue nation states, terrorism threats, continued piracy problems on the high seas, and the emergence of deadly diseases - which could include avian flu.

Asked about negative impressions of the United States among Indonesian people, Sudarsono said they are largely a function of America's broad military and economic power. The U.S., he said, "is so vast that is just tends be perceived as intrusive" and meddlesome, and sometimes as a threat by some.

After 13 years of estrangement, the United States has been trying to improve military relations with Indonesia, which can play a key role in a region dominated by worries about North Korea's nuclearambitions and China's military buildup.

The Pentagon contends that lingering suspicions of Indonesia's connections to terrorist networks, human rights violations and military dominance in government affairs do not reflect significant changes in the country in recent years.

The United States does not appreciate how much Indonesia has changed, said Gates - in what appeared to be a reference to the U.S. Congress, where there have been efforts to restrict military sales to Indonesia.

Gates is visiting five countries during an eight-day tour, and will make stops later this week in India and Turkey. (*)

We have not seen any proof of the spying accusations yet.
Also it's not clear what is being spied on.

No need to close NAMRU2 if Indo is just afraid of spying.
They could just prevent the spying by suitable measures and
agreements instead.
As USA denies the spying-intent, they should accept those
conditions to prevent it.
