Louisiana price gouging laws are now in effect following the state of emergency declaration from Governor Bobby Jindal in response to the oil spill along the Louisiana coast.

Price gouging is when a seller prices merchandise much higher than is reasonable or fair.

The price gouging statutes prohibit the raising of prices above the pre-emergency levels unless there is a national or regional market commodity shortage.

This means that gasoline, petroleum products, hotels, motels, and retailers are prohibited from raising prices during this state of emergency unless they incur a spike in the price of doing business.

The price gouging laws carry both civil and criminal penalties.

Louisiana Workforce Commission Centers throughout State Can Assist with Oil Spill Job Applications

BATON ROUGE (May 4, 2010) - Business and Career Solutions Centers throughout Louisiana can accept applications from job seekers interested in potential jobs that may become available due to the oil spill in the Gulf of Mexico, according to the Louisiana Workforce Commission (LWC).

The LWC is working with companies that have been contracted to provide oil spill-related services. A variety of job positions requiring a range of skill levels may be needed.

Each Business and Career Solutions Center can provide details on available oil spill-related jobs, as well as other jobs in the center?s region, and process applications.

Additional Phone Number for Oil Spill Emergency Truck Permitting Available

BATON ROUGE (May 5, 2010) - The Louisiana Department of Transportation and Development (DOTD) announced an additional phone number for oil spill related truck permitting - 877-452-3683.

In an effort to provide truck permits as quickly as possible to oil spill responders, DOTD has set up an additional emergency phone number through its Customer Service Call Center (877-452-3683) should callers be unable to get through on DOTD's main permit number (800-654-1433).

The Emergency Call Center will operate from 6 am - 5 pm, Monday - Friday. After 5 pm on weekdays and throughout the weekends, callers in need of truck permits related to the oil spill should contact 800-654-1433 for a timely response.

DHH Responds to Emergency Nutrition Needs of Families Affected by the Oil Spill


BATON ROUGE (May 7, 2010) - The Louisiana Department of Health and Hospitals has worked with the USDA to provide emergency food assistance for those affected by the BP oil spill through the WIC nutrition program.

Under new rules, proposed by DHH's Office of Public Health and approved by the United States Department of Agriculture (USDA), people who have lost jobs or sources of income due to the disaster will be able to participate in a streamlined eligibility screening process to receive WIC assistance.

WIC is a supplemental nutrition program for Women, Infants and Children (WIC), which is federally funded by the USDA. The program provides nutrition education and specific food benefits based on nutrients demonstrated to be low in the diets of low-income people, including juice (single strength), milk, breakfast cereal, cheese, eggs, fruits and vegetables, whole wheat bread, fish (canned), legumes (dry or canned), and peanut butter.

Under the emergency rules, clinics in the affected areas have been directed to serve individuals as walk-in appointments with minimal waiting time. The WIC clinic in Plaquemines Parish will be open today, Friday, May 7, and will provide extended hours-the clinic will not end until everyone has been served. It is located at 26851 Highway 23 in Port Sulphur, and can be reached by phone at (504) 564-3344.

The St. Bernard Parish WIC clinic, which is located at 8201 W. Judge Perez Drive in Chalmette, will also be offering walk-in service (no appointment necessary) today, Friday, May 7, as needed. Infant formula samples will be given if needed. Additional clinics will be offering the streamlined process where necessary based upon the movement of the oil slick and the number of impacted residents.


Due to the small number of WIC authorized vendors and their location in Plaquemines Parish, infants will receive sample standard infant formula at the clinic for the month of May (on a non-negotiable food instrument) and food instruments will be given for subsequent months of service. The WIC authorized vendors are as follows:

In other affected areas, DHH's Office of Public Health staff is reaching out to potential WIC recipients by participating in outreach efforts run by local authorities and organizations and educating those in impacted communities about WIC program benefits. Participants in those parishes will receive their vouchers within the next 24 hours as food vouchers are printed at the Crescent City clinic and driven to the Plaquemines clinic to provide expedited access.

BATON ROUGE (May 18, 2010) - The Louisiana Workforce Commission (LWC) has opened mobile units in Grand Isle and Cut Off, offering services for individuals affected by the oil spill in the Gulf of Mexico.

In Grand Isle, services are being offered at the Grand Isle Community Center, 3811 La. 1. Hours of the LWC mobile unit, located on the grounds of the center, are 8 a.m. - 4 p.m. each week day.

In Cut Off, services are being offered at the Cut Off Youth Center, 205 W. 79th St. Hours of the LWC mobile unit there are 8 a.m. - 4 p.m. each week day.

A range of services will be offered, including assistance with applying for potential jobs that may become available due to the oil spill.

The Department of Social Services (DSS) also has staff in the centers at both locations to assist people with applying for social services such as the regular Supplemental Nutrition Assistance Program (SNAP), formerly known as food stamps.

Last week, DSS issued an emergency rule that implements broad-based categorical eligibility for SNAP that will exclude many resources from eligibility determinations, including all payments other than wages received as a result of the incident. Under the emergency rule, resources like business accounts and lump sum insurance payments received from British Petroleum would not be counted as assets or income, making it easier for those affected to be eligible for benefits.

LDWF Schedules Meetings to Outline Preliminary Plans for Waterfowl Hunting Season in Louisiana and Receive Public Comment

BATON ROUGE (July 16, 2010) - The Louisiana Department of Wildlife and Fisheries (LDWF) has scheduled a series of six meetings to address the concerns of waterfowl hunters about the effect of oil in coastal marshes and the upcoming hunting season.

At the public meetings planned between July 26 and Aug. 3, LDWF will convey current plans and take comment from hunters.

"Louisiana hunters can be assured that the waterfowl season is going to open," said Robert Barham, LDWF secretary. "A 16-day teal season, September 11 - 26, was set at the July Commission meeting and continental waterfowl populations are at very healthy levels."

The U.S. Fish and Wildlife Service has said in recent press releases that they believe restricting hunting seasons due to the Deepwater Horizon oil spill is currently unnecessary. LDWF expects the Mississippi Flyway Council to recommend waterfowl hunting season parameters similar to recent years. The council meets during the week of July 19 and state waterfowl hunting regulations will then be set at the La. Wildlife and Fisheries Commission meeting on Aug. 5.

Although LDWF is not recommending any broad-scale closures of waterfowl hunting, if oil is found, some areas may have to close to hunting. Additional closures may be considered if large areas of the coast become covered with oil from tropical storm activity or continued movement of oil into the marshes.

Residents Encouraged to Pre-Apply for Disaster Food Assistance as Tropical Depression Expected to Impact Louisiana

BATON ROUGE (August 11, 2010) - With a Tropical Depression expected to impact Louisiana within the next 48 hours, the Louisiana Department of Children and Family Services (DCFS) is encouraging residents to prepare by pre-applying online for Disaster Supplemental Nutrition Assistance Program benefits (DSNAP), formerly called Disaster Food Stamps.

"Hurricane season is well underway, and this year the potential for disaster is compounded by the oil spill affecting our coast," said DCFS

Secretary Ruth Johnson. "I strongly urge all residents, especially those living in our coastal parishes, to take advantage of our online pre-application for DSNAP."

Johnson said that while a DSNAP program is not expected to be implemented with this storm, now is the perfect time to pre-apply and be prepared for this or any other storm in the future.

DSNAP provides food assistance for eligible households who do not receive regular SNAP benefits and who need help buying groceries due to lost income or damages following a disaster. The state must request that the federal government initiate DSNAP, but can only make the request after the Stafford Act is activated, which has not yet occurred for this tropical depression.

According to Johnson, the pre-application process does not guarantee benefits, but is designed to save time, prevent long waits and to make it easier for applicants to collect the required income information before a disaster strikes.

"I hope all residents will make pre-applying online for DSNAP part of their hurricane preparedness game plan," said Johnson. "By completing the pre-application online, residents are taking a proactive step to prepare themselves and their families for a disaster."



To pre-apply, residents can visit www.dcfs.louisiana.gov or www.getagameplan.org and provide the following information:
  • Names, Social Security Numbers and Dates of Birth for each household member
  • Current address and parish of household
  • Monthly income for each household member
  • All liquid resources for each household member (cash on hand, checking, savings and money market account balances and certificates of deposit)
The information will be kept securely on file and will be confidential.

Residents without Internet access may call 1-888-LA HELP U (1-888-524-3578) to pre-apply.

After a disaster is declared and a DSNAP program is launched, residents who have pre-applied only need to visit a DSNAP issuance site to verify their information and identity, determine final eligibility and receive their benefit cards. Exact eligibility requirements and DSNAP issuance sites will be announced only after a disaster is declared.

Louisiana's federally approved system is the first year-round DSNAP pre-application process in the nation.
