Editorial: Beholden by ASEAN?

The ASEAN Charter, the draft of which is now in the House of Representatives for ratification, puts Indonesia in an awkward catch-22 situation.

Here is a document into which the Indonesian government has put so much attention and resources, including lengthy negotiations, to get it signed by all 10 member governments of ASEAN. But the final text has been heavily watered down from its original form, so much so that the original lofty goals of turning the region into one vibrant community with shared values and shared principles are virtually lost.

Instead, what we have is a document that largely reiterates existing ASEAN agreements and arrangements. As good as they were in bringing together ASEAN countries in the past, the charter could hardly be expected to advance the single community idea.

The charter is a betrayal of a grand vision set by ASEAN's own eminent persons who have laid down the values and principles in their bold and visionary report for an ASEAN community.

This leads us to question whether or not Indonesia, or in this case the House of Representatives, should ratify the ASEAN Charter. It is a question that the Indonesian people, through their elected representatives in the House, have to answer.

Having proposed it to the House, the government's position is already clear: to ratify it. But the House, particularly Commission I on foreign affairs which deliberates the ratification process, does not have to follow the official line.

With all due respect to friends at Jl. Pejambon, who have worked tirelessly to negotiate the charter's text and defend Indonesia's strategic interests in this regional organization, we beg to differ with the Foreign Ministry on this issue.

To ratify would be to sell out on the values and principles Indonesia stands for, including democracy, freedom and human rights -- values and principles that are universal and acknowledged by the ASEAN eminent persons group.

In the absence of these values and principles, one can see that Myanmar, which has just ratified the charter, will continue to repress their people, and pro-democracy leader and Nobel peace laureate Ang San Suu Kyi will continue to linger in jail.

In the absence of these values, many people living in ASEAN countries, and not just Myanmar, will continue to live without their civic rights being observed or protected by their own governments.

Perhaps it would have been too much to ask other ASEAN countries to amend their political systems. ASEAN's 10 members include an absolute monarchy, a military junta-led state, some one-party states, and some liberal and illiberal democracies. While it is not the business of any ASEAN government to push for regime changes in the region, it should not stop Indonesia from insisting on these values and principles being observed within ASEAN, thus written into the charter, if we seriously want to build ourselves a respected community.

A ratification would be a trap for Indonesia, which, because of the sheer size, is seen as the natural leader of ASEAN. Having invested so much in ASEAN, Indonesia would now be beholden by the other members who really need to get their acts together.

One of the problems with the charter is the decision to retain the consensus mechanism for making decisions. This means, as Abdillah Toha, a member of Commission I said in a statement to The Jakarta Post this week, "a country with three or four million people could dictate a country with more than 200 million".

Being a leader of the group making decisions based on consensus has served Indonesia's foreign policy well in the past, but the charter is putting ASEAN in a completely different ball game. The consensus mechanism can no longer be defended if we want to turn ASEAN into a community. The last thing Indonesia wants is to become the leader of a dysfunctional community.

The House of Representatives, in whose hands the fate of the ASEAN Charter now rests, faces two choices.

It could ratify the document with a lot of reservations, including telling Pejambon pointedly to invest less on ASEAN, and reallocate its resources on other more worthy projects. ASEAN is increasingly becoming a straitjacket for Indonesia in pursuing its foreign policy objectives that we should rethink its usefulness in view of recent developments in the region.

The alternative is to reject the ratification, send the text back to the drawing board and insist on a greater commitment from other members to seriously work towards the goal of a genuine single community.

Spirit of ASEAN's Charter

How many treaties or institutions throughout history have been forged with virtuous intent but perverted by legal axiom and manipulated for political compromise?

The integrity of the Association of Southeast Asian Nations has seemed in recent years to be drifting closely towards that unhappy circumstance.

We are proud that ASEAN's senior statesmen, known as the Eminent Persons Group (EPG), have succeeded in drafting an ASEAN Charter that delineates foundations to strengthen the grouping as it meets the challenges of the 21st century.

The charter would create a rules-based community for the 47-year-old grouping. It would present ASEAN with the underpinnings needed to progress toward a more principled and efficient organization, thus allowing it to compete better with regional blocs such as the European Union.

The charter would take life in the form of a binding mini-constitution. Decision making would no longer rely only on consensus and member states who did not comply with agreed-upon treaties could be censured.

More importantly, respect for democratic values and human rights are contained within the charter, thus propelling a greater moral presence in a grouping known more for its acquiescence to despotic regimes.

Thus, the weekend's summit in Cebu, the Philippines, at which ASEAN leaders approved a blueprint for a landmark charter, should be considered a mild breakthrough.

The leaders said they were ""committed to establish(ing) an ASEAN Charter ... to meet future challenges and opportunities.""

Typically they then referred finalization to a high-level committee, which will then submit it back to the leaders.

But as the charter now enters its next phase, we are more worried than relieved.

The draft is now in the hands of politically charged bureaucrats, in a domain where legalese rather than moral values are predominant.

It is hard to shake off the image of men in suits across ASEAN capitals taking out their black markers, ready to cross out the progressive paragraphs hastening ASEAN's enlightenment.

We understand the necessity for officials to nit-pick the draft to ensure its legal propriety. However we are concerned that its spirit and substance could be subverted to suit the political ends of member states.

ASEAN will not stand the test of time if it does not acknowledge the values of freedom and democracy burgeoning across the region.

To alter the document and water it down to the lowest common denominator could result in a charter that bears little resemblance to the visionary stance it was created from.

We believe that it is the duty of Indonesian officials to ensure that the original spirit of the draft charter is retained as intended by the EPG.

Such a task should be regarded as an utmost priority, especially within the Indonesian Foreign Ministry.

As a leader in ASEAN, Indonesia's voice will weigh heavily in the charter's journey from concept to draft to signing.

As Jakarta prompted the inclusion of democratic values in the charter, it should be our duty to see them come to fruition.

Furthermore, the draft cannot be left to languish endlessly as a source of idle chatter, the fate of a number of ""contentious"" documents in the past.

If ASEAN leaders wish to give new life to the grouping, which celebrates its 40th anniversary in August, we should ensure that the charter is adopted by the next summit in November.

There is no excuse to let this deadline pass. The charter as it stands only needs polishing, not rewriting. It is not perfect, but is sufficient for the needs of tomorrow.

Singapore Prime Minister Lee Hsien Loong, who will host the next summit, said he hoped the charter could be approved and signed by then.

But there are no guarantees.

When it comes to ASEAN we should learn to take small steps as giant miracles. Never expect too much, too soon, from a grouping in which informality and lethargy is a proud hallmark.

A most honest assessment came from Malaysian Prime Minister Abdullah Badawi who, when asked about the prospect of the charter being approved by the next summit, replied: ""Let's not try to guess what will happen.

Editorial: Health for all?

As a nation, we should be ashamed for allowing fellow citizens suffering acute illnesses to search desperately from one hospital to the next for accommodation after they were expelled from a state-owned facility.

Ironically, this occurred while Indonesia was supposedly moving toward an ambitious target called "Indonesia Healthy 2010", whereby all Indonesians would gain accesses to quality health care without economic or other obstacles.

So, will it be possible to invert the current situation in less than two years, while there is still a cataract patient who must travel hundreds of kilometers to get surgery? And what about health care for our fellow citizens who live far from Jakarta in areas like Papua, Aceh and East Nusa Tenggara?

These outpatients, who come from low-income families have had a very bitter experience. They now face additional suffering because they could not afford the cheapest accommodation or transportation fares from their hometowns to Jakarta to visit the hospital once a week.

"We don't have any relatives in the city and it is too expensive for us to commute. One way costs us more than Rp 240,000 (US$26)," Siti Hanifa, a patient with stomach cancer from Bandar Lampung, told The Jakarta Post recently, lying on mattress in a house prepared by a volunteer.

Siti is one of 26 outpatients who were told to leave a building owned by state-owned Cipto Mangunkusumo hospital (RSCM) which was reportedly going to be renovated.

Not surprisingly, the group and the case have came into the media spotlight. Many blamed the hospital management for the move, but perhaps forgot the greater issue; the failure of the government to address broader health care problems, particularly for the poor.

This incident should be a blessing in disguise for low-income families, because the media coverage can open the eyes of millions, including policy makers, to the fact there is a real problem at hand.

We should not simply blame the hospital for the incident without learning a lesson from it first. It is true there have been complaints about this hospital, including a lack of transparency about which beds are available on registering as an inpatient there. But in the case of the outpatient expulsion, we may need to address more serious problems otherwise we may see similar situations occurring again.

According to the RSCM management, the hospital has often been overrun with patients, who are referred by local hospitals from across the country. Unfortunately, most of these patients come from low-income families who can not afford accommodation while in Jakarta to receive treatment. Should RSCM foot their accommodation bill, or the local administrations from whose hospitals the patients were initially referred?

Hopefully, policy makers will take this incident into account when they are working out a new policy for health care for low-income families. The incident should provide momentum for them to look more closely at the spectrum of health care problems across the country.

Access for low-income families to proper health care is a complicated problem. We welcome the government's People Health Insurance (Jamkesnas) program. Some 18.1 million low-income families, or some 76.4 million people, are included in this free health care program, and this year the government has allocated Rp 4.6 trillion (US$50 million) to it.

But we still need to encourage the government to eradicate various weaknesses at the implementation level; the unreadiness or reluctance of hospitals supporting the program; fairness in deciding which families deserve the benefit; and provisions for poor families not included in the program.

Many local administrations have reportedly complained there are still many low-income families who do not hold the necessary insurance card -- the only document which can be used to gain access to free health care.

The mission to establish health for all by 2010 is, indeed, a noble effort in helping low-income families gain full access to improved health care. The government's commitment to allocate funds for the program is an initial step, however a more important step is now required to ensure all the funds reach the needy patients and not the pockets of greedy officials.

Listening needed to communicate bird flu risks

Nowadays every democratic society provides a public arena to challenge scientific findings and official measures regarding health and environmental risks posed to the public.

The journalistic field that has emerged in exploring such democratic dialogue is called risk communication.

Risk communication needs journalists to observe journalistic standards like those of Tim Russett, the well-known United States political journalist who died two months ago.

Humbly yet critically listening to diverse voices from both authorities and the public concerning the political issues in question, Tim did his best to present unbiased news, articulating public concerns to the authorities in a tough yet decent manner.

Tim once said that as a journalist, he saw himself as accountable to the public; he was always well-prepared to present news concerning political issues that the public needed to be informed about if they were to be independent in making their own decisions on a well-informed basis.

One of the recent journalism topics covered by risk communication is avian influenza, which has had more human victims reported in Indonesia than anywhere else in the world.

Three years ago this month, in July 2005, avian influenza coverage inundated the news since the government confirmed that the H5N1 virus -- the avian influenza virus -- had claimed three consecutive deaths in a single family.

The news terrified the nation because the government and health experts suspected the H5N1 virus had mutated into a human-to-human virus which might soon create the world's next lethal influenza pandemic.

Since then most journalists have based their reports on avian influenza by listening to and gathering information from government officials as well as from health and animal experts.

Very few, unfortunately, have listened to and reported on the concerns of the public, although basic livelihoods have been seriously affected by the virus.

Creating news stories merely from the points of view of elites, such as political pundits, related authorities and scientific experts is a (traditional) legacy of watchdog journalism.

Such journalism was considered the ideal working principle of any accountable news media particularly in the 1950s to the 70s.

However, since the 1980s, as many parts of the world have moved towards embracing democratic principles, of which public concerns and public service are a vital part, the traditional practices of watchdog journalism have no longer been sufficient.

What is increasingly in demand is in-depth journalism that is capable of channeling a variety of opinions, such as those expressed by left, right and non-aligned parties, or by conservative, liberal and independent groups, or authorities, experts and the lay public and so forth.

Such journalism makes a robust endeavor to listen to and then present a complexity of opinions; it strives to create a more genuine democratic dialogue between the public and the elite, who together can exchange views to come up with a more realistic and appropriate decision for dealing with pressing social concerns or issues.

The effort to create a mode of journalism emphasizing the need to listen to all strata of society has grown out of the fact that in the past the messages or measures set/determined by authorities and experts have been at odds with public realities.

The public has often been judged or labeled as irrational, ignorant and/or stupid whenever their responses did not comply with official messages or measures.

Official measures and scientific findings advocated by the authorities have been found not to provide the best and most lasting solutions, especially in matters concerning health and environmental risks, e.g. the health and environmental damage caused by long-term use of chemical fertilizer in industrialized agriculture.

Realizing that too much reliance on the political and scientific facts has proven defective, risk communication journalism has incorporated various social science concepts in order to present a more robust perspective on health and environmental risks.

In covering risk issues, such journalism also embraces the psychological notion that it is what people feel that matters, especially in shaping changes to social behavior.

Journalists need to be critically aware that their stories not only include the official, the government's and experts' information and measures, but also present public opinions.

Since 2006 the government, with support from national and international agencies and countries, has launched various media campaigns to raise public awareness of the threats from bird flu.

Despite serious efforts, the outbreaks of avian influenza and the number of human victims in Indonesia are still the highest in the world.

Many communities, especially outside of Java and Bali remain ignorant, despite the awareness campaigns that have reached them.

It has felt as if the avian influenza threat was a distant problem, or specifically a Java problem, which did not affect them.

Risk communication journalists in Indonesia still have lots of homework to do.

They need to use as a model Tim Russett's journalism ethics in working on his news pieces.

Rather than being satisfied with the various kinds of one-size-fits-all "Beat The Bird Flu" campaigns, journalists need to lend their ears more to the impact that awareness campaigns have or might have exerted on people's daily lives.

Then, they should be accountable to the public for respectfully presenting very critical views to the government regarding the relevance of campaigns and official measures among diverse communities.

The stories of the ways the H5N1-infected communities have dealt with risks in accordance with local conventions might become sources of ideas for other communities to be more pro-active, creative and independent in making their own decisions in facing these risks.
