Canada won?t issue visas to residents of countries with widespread Ebola

TORONTO ? Canada is following in Australia?s footsteps and is suspending visa applications for residents and nationals of the West African countries battling Ebola.

The federal government signalled it would stop issuing visas in the worker, student or visitor class and won?t issue any pending permanent residency visas for people from those countries either.

Any applications already in the system will also not be processed at this time.

The change, which goes into effect immediately, was announced today in the Canada Gazette.

A spokesperson for the minister of Citizenship and Immigration says the move is similar to but a bit less restrictive than the one the Australian government announced this week.

That move was slammed Thursday by Dr. Margaret Chan, the director general of the World Health Organization, who said closing borders will not stop spread of the Ebola virus

Canada is following in Australia's footsteps and has suspended, effectively immediately, the issuance of visas to residents of the West African countries battling Ebola.

In a move that puts Canada at odds with the World Health Organization, the federal government said Friday it is suspending visa applications for residents and nationals of countries with "widespread and persistent-intense transmission" of Ebola virus disease.

That stress on countries with widespread transmission provides an out for the United States, which currently still has at least one active Ebola case within its borders.

Ministerial Instructions

Notice is hereby given, under subsection 87.3(6) of the Immigration and Refugee Protection Act (IRPA), that the Minister of Citizenship and Immigration has made the following Ministerial Instructions that, in the opinion of the Minister, will best support the attainment of the immigration goals established by the Government of Canada. The Instructions are consistent with the IRPA objectives as laid out in section 3 of the Act and are compliant with the Canadian Charter of Rights and Freedoms.
Authority for these Ministerial Instructions is pursuant to section 87.3 of the IRPA. Instructions are directed to officers who are charged with handling and/or reviewing applications for permanent or temporary visas to enter Canada.

These Instructions do not affect the authorities where it is justified in the circumstances to give discretionary relief facilitating entry to Canada.

Considerations

Recognizing that there is an outbreak of a communicable disease in several regions of West Africa;

Recognizing also that the introduction or spread of the disease would pose an imminent and severe risk to public health in Canada;

Recognizing also that the entry into Canada of persons who have recently been in those regions may introduce or contribute to the spread of the disease in Canada; and

Noting that the IRPA objectives as laid out in section 3 of the Act provide that one of the objectives with respect to immigration is to protect the health and safety of Canadians:

These Instructions are made in order to assist in the prevention of the transmission and spread of the Ebola Virus Disease in Canada.

Scope and application

These Instructions will come into force on October 31, 2014 and apply to pending applications (applications received by Citizenship and Immigration Canada [CIC] before the coming into force of the Instructions, and in respect of which a final decision has not been made) and new applications received by CIC offices on or after October 31, 2014.

Any categories for which Instructions are not specifically issued, including visa-exempt foreign nationals and applicants who have not travelled to Ebola affected countries, shall continue to be processed in the usual manner.
For further clarity, these Instructions do not have any effect on holders of valid visas, protected persons, permanent residents and Canadian citizens.

Ebola affected country

For the purpose of these Instructions, ?Ebola affected country? shall refer to countries identified by the World Health Organization as having widespread and persistent/intense transmission of the Ebola Virus Disease.

Applications for temporary residence

CIC will not process new visa applications nor continue to process pending visa applications for temporary residence in the worker, student or visitor class of foreign nationals who have been in an Ebola affected country (which includes having resided, travelled or transited), within three months prior to the date the application is received by CIC.

CIC will not process new visa applications nor continue to process pending visa applications from foreign nationals who are intending to travel to an Ebola affected country.

These Instructions do not apply to renewals, extensions, and restorations of temporary resident status of foreign nationals who are in Canada at the time of application and at the time of decision on renewal, extension, and restoration.

Applications for permanent residence

CIC will not process new permanent resident visa applications made by foreign nationals who have been in an Ebola affected country (which includes having resided, travelled or transited) within three months prior to the date the application is received by CIC.

These Instructions do not apply to applications from foreign nationals with valid temporary resident status applying for permanent residence while in Canada.

In order for an officer to issue an approval (final positive decision) of a pending permanent residence visa application, the officer must be satisfied that the applicant has not been in an Ebola affected country (which includes having resided, travelled or transited) in the three-month period prior to the issuance of a visa or other document under section 11 of IRPA.

Retention/disposition

Foreign nationals with new visa applications or pending visa applications for temporary residence who do not qualify for processing shall be informed that their application will not be processed and their processing fees shall be returned.

Foreign nationals with new visa applications for permanent residence who do not qualify for processing shall be informed that their application will not be processed and their processing fees shall be returned.
Pending permanent residence visa applications affected by these Instructions shall be retained.

Canada is a signatory to the International Health Regulations ? often called the IHR. Nuttall is the head of the WHO?s department of global capacities alert and response, which is responsible for overseeing the implementation of the health security treaty.

Nuttall said the WHO has asked Canada?s IHR focal point ? the person within the Public Health Agency of Canada tasked with communicating with the WHO on IHR-related issues ? for an explanation. She wasn?t clear when the request was sent but said the WHO has yet to receive a reply.

Feds and WHO discuss Canadian Ebola-related travel restrictions

The Canadian government and the World Health Organization have met to discuss travel restrictions Canada imposed on residents of countries with widespread Ebola transmission, both parties confirmed Friday.

International health law experts say Canada?s move to stop issuing visas to people from the affected countries contravenes the International Health Regulations (IHR), a treaty Canada helped revise after the 2003 SARS outbreak. Earlier this week the WHO asked Canada for the scientific and public health rationale underpinning the decision.

After the meeting, however, both parties appeared to have agreed to an accepted line on Canada?s visa restrictions. And while that message seems to imply that the World Health Organization has no problem with Canada restricting travel from the three countries, no one from the WHO would explicitly confirm that on Friday.

?The WHO is satisfied that these measures do not represent a general travel ban and will not impact on the movement of Canadians who wish to participate in the humanitarian response in West Africa,? Citizenship and Immigration Canada said in an email.

Canada rejects 176 visitors from Ebola-affected countries

OTTAWA ? Newly-released figures show an estimated 176 people were turned away from Canada after the imposition of a partial travel ban from Ebola-affected countries in West Africa.

The federal government put the controversial measures in place at the end of October, barring people from Guinea, Liberia and Sierra Leone from receiving visas to come to Canada.

At the same time, the government announced it would also stop processing visa and visitor applications in the queue.

In newly-published information, the immigration department says an estimated 176 applications have been affected, resulting in a return of approximately $20,000 in fees.

Six people from Ebola-affected countries coming to Canada

There are no specific details about the six, but the immigration minister can grant visas in cases where travel is in the national interest.

OTTAWA?Six people from Ebola-affected countries have been granted visas to come to Canada despite a federal government ban imposed on such travel last year.

The government isn?t releasing any specific details about the six, citing privacy concerns.

They aren?t believed to have been travelling together and each would have been required to undergo screening for the highly contagious virus before they left West Africa and again upon arrival in Canada, including a 21-day monitoring period.

?I can confirm that there are no Ebola cases in Canada,? Patrick Gaebel, a spokesman for the Public Health Agency of Canada, said in an email.

?Should a case ever be confirmed, the Public Health Agency of Canada would quickly inform all Canadians.?
