More listeriosis cases confirmed

Listeriosis cases linked to contaminated cantaloupe from a Colorado farm continue to mount in Kansas and Missouri.

Kansas health officials said Friday that federal investigators have confirmed that three more listeriosis cases in the state are part of the national outbreak, bringing Kansas’ total to 10. Three of the people have died.

In Missouri this week, an 84-year-old became the second person in the state to die after developing listeriosis linked to the cantaloupe. So far, there have been six confirmed cases in Missouri; all have been hospitalized. ​

As of 9am EDT on October 24, 2011, a total of 133 persons infected with any of the four outbreak-associated strains of Listeria monocytogenes have been reported to CDC from 26 states. All illnesses started on or after July 31, 2011. The number of infected persons identified in each state is as follows: Alabama (1), Arkansas (1), California (2), Colorado (37), Idaho (2), Illinois (3), Indiana (3), Iowa (1), Kansas (10), Louisiana (2), Maryland (1), Missouri (6), Montana (1), Nebraska (6), New Mexico (14), New York (2), North Dakota (1), Oklahoma (11), Oregon (1), Pennsylvania (1), South Dakota (1), Texas (18), Virginia (1), West Virginia (1), Wisconsin (2), and Wyoming (4). Among persons for whom information is available, illnesses began on or after July 31, 2011. Ages range from <1 to 96 years, with a median age of 77 years. Most ill persons are over 60 years old. Fifty-six percent of ill persons are female. Among the 130 ill persons with available information on whether they were hospitalized, 128 (98%) were hospitalized. State and local health departments in these and other states are investigating other listeriosis illnesses to determine if they are part of this outbreak.

Twenty-eight deaths have been reported: Colorado (7), Indiana (1), Kansas (3), Louisiana (2), Maryland (1), Missouri (2), Nebraska (1), New Mexico (5), New York (2), Oklahoma (1), Texas (2), and Wyoming (1). Among persons who died, ages range from 48 to 96 years, with a median age of 84 years. In addition, one woman pregnant at the time of illness had a miscarriage.

Four of the illnesses were related to a pregnancy; one was diagnosed in a newborn and three were diagnosed in pregnant women. One miscarriage has been reported. Other outcomes are being monitored.

As of 9am EDT on November 1, 2011, a total of 139 persons infected with any of the four outbreak-associated strains of Listeria monocytogenes have been reported to CDC from 28 states. Nevada and Utah have reported their first case each since the last CDC update.

Twenty-nine deaths have been reported: Colorado (8), Indiana (1), Kansas (3), Louisiana (2), Maryland (1), Missouri (2), Nebraska (1), New Mexico (5), New York (2), Oklahoma (1), Texas (2), and Wyoming (1). Eleventh Listeriosis Case Associated with Jensen Farm Cantaloupe Outbreak

Another death from listeriosis has prompted a wrongful-death lawsuit in MO, according to the KansasCity.com website. The man died Dec. 18th (after the CDC Final Update), bringing the total deaths to 31.

Food Safety News reports another death (62 year old) from Listeria in cantaloupe, bringing the total deaths to 32.

According to denverpost.com, another death has occurred from listeriosis found on cantaloupes. It lists the 68 year-old man as death number 34. He had been sick for five months. http://www.denverpost.com/breakingnews/ci_20013060#ixzz1n4C2DxcL

HOLLY, Colo., Sept. 26 (UPI) -- Two Colorado cantaloupe growers turned themselves in to U.S. authorities Thursday to face misdemeanor charges in a 2011 outbreak of listeria, prosecutors said.

Eric Jensen, 37, and Ryan Jensen, 33 -- who owned and operated Jensen Farms in Granada, Colo. -- were charged Tuesday with six counts, including introducing adulterated food into interstate commerce, the Food Safety News website reported.

Jensen Brothers Plead Not Guilty to Six Federal Counts in Cantaloupe Case

UPDATE: Brothers Eric and Ryan Jensen were brought into federal court in Denver on Thursday afternoon in shackles, but they walked out their arraignment as free men, at least until their trial. The two men pleaded not guilty on all counts and were released on a $100,000 unsecured bond, meaning that they don’t have to put up any money unless they violate bail conditions imposed by the court.

Their trial date was set for Dec. 2, and government attorneys said they will need two weeks to present their case.

Farmers Tied to Listeria Outbreak to Plead Guilty

Two Colorado cantaloupe farmers plan to plead guilty under a deal with federal prosecutors in connection with the 2011 listeria outbreak that killed 33 people in the nation's deadliest case of foodborne illness in a quarter century.

Eric and Ryan Jensen were charged last month with introducing adulterated food into interstate commerce. At the time, the Food and Drug Administration said the rare move was intended to send a message to food producers.

Criminal charges are rare in food-borne illnesses, but the FDA under President Barack Obama has been more aggressive in pursuing farmers and food processors for alleged lapses.

Two Colorado brothers whose contaminated cantaloupe farm was tied to 33 deaths in one of the nation?s worst food-borne sickness outbreaks won?t have to serve prison time.
A federal court judge in Denver on Tuesday sentenced Eric and Ryan Jensen to five years? probation, six months? house arrest and ordered them to pay $150,000 each in restitution, the U.S. Attorney?s office said.
The farmers had been facing as much as six years in prison and a $1.5 million fine.

The U.S. is believed to have the safest food supply in the world, yet last year 48 million people were sickened by tainted food.
The light sentence was disappointing to folks like Paul Schwarz, 64, of Missouri, whose father died from the listeria outbreak in 2011.

Wal-Mart Stores Inc., facing a lawsuit from the family of a man who died after eating a cantaloupe bought at one of its tores, is now suing the grower, distributor and the grower?s third-party auditor.
Wal-MartThe lawsuit appears be a new strategy against lawsuits by victims of the deadly 2011 listeria outbreak linked to cantaloupes grown by Jensen Farms.
In a complaint filed in Wyoming federal court in late January, Wal-Mart asserts third-party claims against Edinburg, Texas, distributor Frontera Produce Ltd., auditors Primus Group Inc. and Bio Food Safety Inc., and Jensen Farms. Primus subcontracted Bio Food Safety to undertake the on-site audit of the cantaloupe farm, which resulted in a superior rating of 96%.
