        Here is the obituary for the U.S. citizen who died in Canada - he was Robert A. Derzon, the first Director of Medicare and Medicaid.



        Robert A. Derzon, the first director of the federal agency that manages Medicare and Medicaid, died June 17 in Orangeville, Ontario, where he was visiting a friend. He was 78 and lived in Mill Valley, Calif.

        The cause was swine flu, Mr. Derzon?s son Mike said.

        Mr. Derzon, who had previously been deputy commissioner of New York City?s Department of Hospitals, was chosen by President Jimmy Carter in 1977 to head what was then called the Health Care Financing Administration. Now called the Centers for Medicare and Medicaid Services, the agency was created in March 1977 to coordinate the two programs, which since they were created in 1965 had been run separately. Essentially, Medicare provides health insurance for people 65 and over and Medicaid provides insurance for poor people.

        In his two years as director, Mr. Derzon faced the difficult task of minimizing fraud and abuse in the programs and the apparently insurmountable task of slowing the soaring rate of hospital cost increases. His cost-cutting suggestions were sometimes controversial.

        In a memo sent on June 4, 1977, to Joseph A. Califano Jr., the secretary of Health, Education and Welfare at the time, Mr. Derzon suggested that the federal government adopt a ?living will? law similar to one enacted by California. Living wills permit patients to authorize their doctors to terminate life-support systems when there is no chance for a cure or recovery. He also favored Medicaid financing of abortions for mothers on welfare.

        Throughout his career, Mr. Derzon was a proponent of universal health care coverage. In 1969, when he was first deputy commissioner of New York City?s Hospitals Department, he told a state legislative committee that the existing method of paying for health and hospital care was ?a disaster.?

        ?The vast majority of our population in suburban, urban and rural areas is not receiving convenient and economically produced quality health services,? he said. Because of Medicaid cutbacks, he added, hospitals that had expanded health services to the poor in the city were ?on the brink of fiscal disaster.?

        Robert Alan Derzon was born in Milwaukee on Dec. 30, 1930, one of two sons of Matthew and Mildred Gordon Derzon. Mr. Derzon graduated from Dartmouth in 1953 and received a master?s degree in 1955 from the Amos Tuck School of Business at Dartmouth. In 1956, he received a master?s degree in public health administration from the University of Minnesota.

        From 1960 to 1966, Mr. Derzon was associate director of the New York University Medical Center. He was first deputy commissioner of New York?s hospital department from 1966 to 1969 and acting commissioner in 1970. Before being appointed to the federal post, he was director of the University of California?s medical school hospital in San Francisco.

        Mr. Derzon?s wife of 54 years, the former Margo Harris, died in 2002. Besides his son Mike, he is survived by another son, James; a daughter, Andrea Merenluoto; his brother, Gordon; and nine grandchildren.

            Sorry if this is confusing anyone. I would just like to reiterate a debate that we had earlier over how this list is organized: the locations on our list attempt to reflect where infection may have occurred, not strictly location of death or residency. If someone dies while visiting another country or U.S. state, it is not clear if they brought the infection from home or picked it up while traveling. So for instance, Texas #1 was a Mexican resident, and Las Vegas #1 was a New York resident. Anyone who is transferred over state lines for medical treatment is still listed as a fatality under their state of residency, as in Pennsylvania #3 Pike County woman.

            Because Robert Derzon became ill and died while traveling, I am going to keep him under the "U.S. Deaths Abroad" heading and not count him as a U.S. death.

            Is that okay or does someone have another idea about how to organize the list?

                    Good point on pregnant victims.
                    I know that people are often charged with a double homocide when the victim is pregnant.
                    Is there a specific point in the pregancy when the fetus becomes an additional victim?

                      I vote no to miscarriage as they are quite common. I vote yes to any baby that they deliver early due to the mother having H1N1 and dies.

                        It depends on state law - some (most?) states have made the killing of a fetus while in utero (regardless of the baby's viability) a crime. For example, Scott Peterson was convicted of murdering both Laci and their unborn child.

                        I think appleblossom's solution of only counting those who would have a death certificate is a good one - it's a clear line without getting into other sticky issues.

                          That makes sense, especially because the Canadians continue to list him in their totals for deaths.

                            I'm inclined to say 'no', only because the convention seems to be reflected in the case of the Scottish woman who died from H1N1, followed by death of her baby (non-H1N1), born prematurely at 29 weeks. Her death was counted as the only reported flu death, and the baby was not.

                              I started a separate thread for this issue. I agree with you appleblossom, I certainly don't want to get into a debate over when life begins, but only wanted to see what people thought about counting deaths in these cases. The case in the UK would be the type of case where I think counting the child's death would be warranted. The baby was delivered premature by C-Section well beyond the point of viability outside the womb, but died a few days later. I imagine that the child received both birth and death certificates.

                              I agree with Pflu that counting miscarriages doesn't make sense. But I do believe we will see many more cases where babies will be delivered by C-Section when the mother is in grave danger. There is the UK case, a case in Buenos Aires where the baby survived, and a case in Chicago with a 20-yr-old mother who died, but I'm not sure if the baby survived after it was delivered. There is also a case in my home town where the baby has been delivered and is in NICU. The mother is still alive, but has "double pneumonia" and ARDS. A good friend of ours, who is her neighbor, told us that the doctors said she has bacterial pneumonia. And, now her mother, who lives with her, has the same thing. Amazingly, I don't think they've even tested either for flu.

                              Anyway, however it's decided is fine with me, I just wanted to know how it would be handled going forward.
