A time-limited IP waiver would provide legal certainty so that prospective manufacturers across the world can initiate plans to produce. Last year, Moderna said it would not enforce its vaccine patents during the pandemic. However, without knowledge transfer, including trade secrets, other manufacturers cannot produce this vaccine on an accelerated timeline. Moderna’s refusal to license technology to other manufacturers has been criticized because its vaccine was developed primarily with public funds. According to the former director of chemistry at Moderna, if knowledge were shared, supply could increase in as little as 3 months.
