    The Phra Khanong Provincial Court yesterday dismissed a lawsuit brought against three doctors and two private hospitals who were accused of causing the death of a young patient.

    Thawatsit Tuangsinkunbodi and his wife, Thanyapat, the parents of Phirawi Tuangsinkunbodi, 28, told the court the three doctors who work at Sikarin and Thainakarin hospitals had failed to prescribe their son proper anti-viral drugs which caused his death.

    They believe Phirawi contracted type-A (H1N1) flu while visiting a younger cousin who was sick with the virus in June 2009 at Sikarin Hospital.

    However, the court ruled the man had not died from the virus, but as a result of acute respiratory failure.

    The court then dismissed the 31.2-million baht lawsuit lodged by Phirawi's parents against the three doctors and the hospitals.

    The parents told the court earlier that Sikarin doctor Damrong Prakaithip allegedly sent Phirawi home after diagnosing his illness as a cold.

    After his conditioned worsened, they said, Phirawi was taken back to the hospital where another doctor, Sutthisak Chaiatchanarat, diagnosed Phirawi as having pneumonia and sent him to Thainakarin hospital to be treated by a specialist.

    The specialist, Hiran Sichintai, also diagnosed pneumonia without checking whether type-A (H1N1) flu virus could be the cause of their son's illness, the parents said.

    Phirawi's condition did not improve at Thainakarin either so his parents decided to take him to Bumrungrad hospital where he later died.
